Introduction

These Terms set out the legally binding terms which apply to everyone who accesses or uses the websites at www.ifi.iewww.ifibooking.ie and www.irishfilm.ie (“Website”). Please read the Terms carefully before using these Websites. By accessing or using these Websites, you agree to be bound by these Terms. If you do not wish to be bound by these Terms, you must leave this Website immediately.

These Websites are owned and operated by Irish Film Institute (“IFI”) (a company registered in Ireland, whose registered office is at 6 Eustace Street, Temple Bar, Dublin 2).

Your statutory rights
Nothing in these Terms affects your statutory rights as a consumer, or excludes or limits our liability for fraud, or for death or personal injury resulting from our negligence, or for any other liability which we cannot exclude or limit under law.

Ownership of Materials and Licence Terms
This Website and the materials on it are protected by copyright, trade mark and other intellectual property rights and laws throughout the world. The materials on this Website are owned by or licensed to IFI. You are permitted to display the materials on this Website on a computer screen and to download and print a hard copy of such materials strictly for your own personal use and provided you do not alter or remove any copyright, trade mark or other proprietary notices. You undertake not to:

  • commercially exploit any materials on this Website without our express prior written consent;
  • establish a link to this Website from any other website, intranet or extranet site, without our express prior written consent;
  • use this Website to upload or distribute any material that contains viruses or anything similar;
  • infringe the rights of any other person;
  • do anything that will or may interfere with, disrupt, damage or impair this Website or our provision of services; and/or
  • submit any information to this Website which is defamatory, obscene, offensive, liable to cause harassment or distress and/or which does not comply with any law.

You may not frame or use framing techniques to enclose any material on this Website or any part of it without our express prior written approval. You may not use any meta tags or other hidden text using the trade marks or trade names of the IFIwithout the express prior written consent of the IFI.

You are prohibited from de-compiling, reverse engineering, disassembling, or otherwise reducing the code used in any software on this Website into a readable form. You are prohibited from circumventing or attempting to circumvent any of our security safeguards or those of our suppliers.

User names and passwords
You are responsible for any use of your username and password, and you must keep them confidential. If you become aware of any unauthorised use of your password, you must change your password by visiting the registration page of this Website.

Availability of this Website
This Website is provided free of charge and we make no guarantee that it will be uninterrupted or error free. In addition, we reserve the right to modify or discontinue, temporarily or permanently, all or any part of this Website without notice and without liability.

Links from this Website to third party websites
This Website contains links to other websites which are not controlled by us. For example, if you click on a banner advertisement, the click may take you off this Website. The fact that we may provide a link to any such website does not mean that we endorse that website. Such links are provided only for your convenience and we have no control over such websites. Subject to paragraph 3 (“Your statutory rights”), your access to and use of such websites is at your own risk and we shall have no liability in respect of those websites.

Online ticket purchases
Except in accordance with paragraph 30 there are no rights of refund or exchange and you acknowledge that the cancellation rights contained in the European Communities (Protection of Consumers in Respect of Contracts made by means of Distance Communication) Regulations 2001 (as amended) do not apply to the services we offer.

English is the only language offered for the conclusion of the contract for the purchase of cinema tickets.

The Prices of the tickets are those displayed on the Website from time to time, during the ordering process, except in cases of obvious error. In addition to the ticket price a Booking Fee levied by IFI is payable on online transactions, and this will be notified to you during the ordering process. All prices and fees include any applicable Value Added Tax. All prices are in Euros.

IFI will deduct your payment from your card at the time it processes your credit/debit card transaction. You cannot use any promotional vouchers or discount cards in conjunction with a ticket purchase via this Website (if you wish to do this, you will need to visit the IFI in person). You cannot use guest passes to pay for a ticket purchase via this Website (if you wish to do this, you will need to visit a cinema in person or phone the booking number on the back of the guest pass). If you are a student, you can still benefit from the student price, but you must bring your proof of student identity to the cinema when you collect your tickets.

When you purchase a ticket via this Website, all transaction details that you provide to IFI (including your name and credit card details) will be held and used in accordance with our Privacy Statement and will be encrypted using SSL (secure sockets layer) technology. IFI will take reasonable steps to safeguard transaction details, but you acknowledge and agree that the use of Internet booking can never be completely secure. Subject to paragraph 3 (“Your statutory rights”), unless IFI has been negligent, IFI shall not be liable for any loss or damage you may suffer as a result of the loss of confidential or personal information provided to IFI via this Website.

The sale of cinema tickets is subject to availability. Your order for a cinema ticket is an offer to purchase a ticket from the IFI retains the discretion to refuse your order. If IFI accepts your order, we will display a confirmation page on your screen at the end of the ordering process, and at this point there will be a contract between you and IFI. We will also send to you a secondary e-mail confirmation of your completed order, for your information. We do not file details of your order for you to access on this Website, so we recommend that you print out a copy of the confirmation page and/or confirmation e-mail for your records.

Tickets can be collected from the box office when your credit/debit card transaction and the entire ordering process has been completed. We also have automatic ticket machines (“ATMs”) from which you can collect your tickets. For security reasons, the cardholder must be present to collect the tickets, and you will need to take the same card as you have used to make your booking.

You represent and warrant that any tickets you purchase are for personal use only, and that they are not purchased as part of any form of for profit business or commercial activity, unless we have expressly authorised otherwise in writing.

You undertake that you will not resell or offer for resale any tickets (whether at a premium or otherwise) or use tickets for advertising or promotions (including prize draws, competitions, contests and/or sweepstakes) or for any other trade purposes. If you resell or offer for resale any tickets, then they will be invalid.

It is your responsibility to check your tickets as we are under no obligation to rectify mistakes after a contract has been formed. Please also note that we are not under an obligation to provide the ticket(s) to you at the incorrect (lower) price, even after the confirmation page has been displayed and the confirmation email has been sent to you, if such a pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mis-pricing.

Seating will be unreserved unless otherwise specified expressly during the ordering process.

It is your responsibility to ascertain whether a screening has been cancelled or rescheduled. If a screening is cancelled or rescheduled (for whatever reason), we will use reasonable endeavours to notify you of the cancellation or rescheduling but we do not guarantee that you will be informed of such cancellation or rescheduling before the date of the screening.

Photography on IFI Websites

The IFI may take photographs during public events in the IFI Foyer where audiences may on occasion be identified. On these rare events the public will be informed by signage that photographs are being taken but it is up to the IFI patron to inform our staff if there is an issue. Photographs will be used for the IFI website and social media networks.

We will not be responsible for any tickets that are lost or stolen. The unauthorised use of photographic and recording equipment in our cinemas is prohibited. We accept no responsibility for any personal property that is brought to a cinema. Price and availability information is subject to change without notice. Tickets cannot be exchanged or refunded.

Non-compliance with these Terms
We reserve the right to investigate any suspected non-compliance with these Terms. If we believe that a violation of these Terms (or any of the rights identified in these Terms) has occurred, we may suspend or bar your access to this Website or take such other corrective action as we deem appropriate.

Limitations on IFI’s liability to you
We will use reasonable endeavours to ensure the accuracy of any information on this Website, but we make no representation or warranty of any kind that this Website or any of its contents will be accurate, current, complete, or error-free. Unless we have been negligent, we accept no liability of any kind for any loss or damage arising from action taken in reliance on information on this Website.

We will use reasonable endeavours to exclude computer viruses from this Website, but we make no representation or warranty of any kind that this Website or any of its contents will be free from computer viruses introduced by third parties. Unless we have been negligent, we accept no liability of any kind for any loss or damage caused by computer viruses.

Subject to paragraphs 3 (“Your statutory rights”) and 37, in the event that you purchase cinema tickets online via this Website, our liability (whether in contract, tort (including negligence), statute or otherwise) arising out of or in connection with the purchase of those tickets shall be limited to the price paid by you for those tickets.

Subject to paragraph 3 (“Your statutory rights”), we will not be liable to you for any:

  • loss of profits;
  • loss of revenue;
  • loss of anticipated savings;
  • loss of business;
  • loss of opportunity;
  • loss of data;
  • loss of or damage to goodwill or reputation; or
  • any indirect or consequential loss or damage,

whether arising under contract, tort (including negligence), statute or otherwise.

Events outside our control
We will not be liable or responsible for any failure to perform, or delay in the performance of, any of our obligations that are caused by events outside our reasonable control.

Jurisdictional issues
This Website is directed only at users in the Republic of Ireland and you may only use this Website to purchase tickets if you are domiciled in the Republic of Ireland. If you access this Website from outside the Republic of Ireland, you do so at your own initiative and risk, and you are responsible for compliance with any applicable local laws.

These Terms and your access to or use of this Website including any purchase of tickets are governed by Irish law and any dispute arising in connection with this Website shall be subject to the non-exclusive jurisdiction of the Irish courts.

Changes to the Terms
Notwithstanding anything to the contrary, we reserve the right to amend these Terms from time to time without notice. Amendments will take effect when posted on this Website when made by us. Please check this Website and (in particular), this page regularly for changes or information about changes. If you access or use this Website after any amendment to these Terms has taken effect, you hereby agree to be bound by the updated version of these Terms.

Prize draws and competitions
By entering an IFI prize draw or competition, unless specific prize draw or competition terms are set out in conjunction with the details of that prize draw or competition (in which case the prize draw or competition will be governed by such terms), you agree to be bound by the terms and conditions set out below:

  • Winners will be contacted by an appropriate method shortly after the closing date;
  • All prizes are non-transferable;
  • Judge’s decision is final. No correspondence will be entered into;
  • No cash alternative. The promoter reserves the right to substitute prizes with goods of an equal or greater value in the unlikely event that these exact prizes become unavailable;
  • No trade, consumer groups or 3rd party applications acceptable;
  • The promoter reserves the right to disqualify incomplete, altered or illegible entries;
  • The promoter is IFI;
  • The competition/prize draw is governed by the law of Ireland.

IFI Membership & Loyalty Terms & Condition
IFI reserve the right to (a) terminate the scheme (b) withdraw or cancel the card on reasonable grounds or (c) alter or change the conditions of the Loyalty or Membership Card. Reasonable grounds include; abuse or attempted abuse to the scheme.

  • All Memberships are non-exchangable, non-refundable and non-transferable. Membership card use is permitted only by the person to whom it has been issued.
  • No cash alternatives are permitted.
  • Your Loyalty or Membership Card cannot be used as a guarantee card or as a credit card.
  • The IFI Loyalty Card cannot be sold or traded in any way.
  • Members can be removed from the Loyalty Card or Membership scheme at the discretion of Irish Film Institute.
  • Cards and points carry no cash value and may not be exchanged for any other offer or service.
  • Cannot be used in conjunction with any other offers.
  • If you have selected a monthly (12 months) payment, your payments will cease after 12 months and you will need to renew your membership online or by contacting our box office.
  • If you have selected a recurring annual payment, your membership will be automatically renewed after 12 months without renewal notification.
  • If you have selected a once-off payment, you will need to renew your membership at the end of the year. You will receive a expiry notification.
  • If your payment details change, you can update them in your account by logging into your online account.
  • If you decide to change your renewal method it will be effective when your current subscription expires. Please note that the value of your current subscription will not be reimbursed.
  • If you have purchased a membership in error, please contact Box Office or membership@irishfilm.ie within 24 hours of your purchase.
  • Please note, if you choose to upgrade your membership during the year, your payments will be updated with the new amount and will commence as a new membership for 12 months. Any value remaining on the original membership cost will not be reimbursed to you.
